Licensing and supervision

Organizations providing daycare and out-of-school care must have an operating license. This license is issued by the public entity if the organization meets the criteria outlined in the Childcare Island Ordinance. Grace periods may apply to certain requirements, allowing organizations a longer period to meet the criteria. New organizations, however, have no grace period; they must comply with all conditions immediately.

The Inspectorate of Education checks whether the regulations in the Childcare Island Ordinance are being met. If the inspectorate finds that an organization no longer meets the requirements, it takes action. If the inspectorate concludes that the operating license of a childcare organization should be revoked, it advises the public entity, which then makes a decision.

The licensing system, supervision, and enforcement policies must be formalized in legislation and island ordinances by 2026 and come into effect.
